And what i mean by that is making so say my undead mage looks like a gnome mage
(i don't want that to happen just using it as an example) i have heard on other WoW forums that this is against the ToS and other ones saying it is legal...im not going to do this because i don't want to get banned...but could i get a blue response please?

It's hard to say.

It is technically tampering with the files, but it isn't hurting anyone...

its a violation of the TOS/EULA theres a thread on the ui forum with links to blue post on it

as of 1.11 it is much harder to do

and warden can flag your account for action to be taken aginst it if it detects that you have brute forced changed the files wich it can check for.

or rather blizzard can easily make warden do this and mostlikely will in the near future

Before, so far as I'm aware, you just had the models in an appropriately named folder matching the tree structure of the MPQ file. This is not brute force at all, WoW actively loads them outside their own MPQs.

That said, there should be a way for Blue to turn off this functionality come production time.

yes thats true. but thats no longer the case now. the game will not allow the override

While I don't make a habit of contradicting GMs, I'm going to say that this isn't a good response here, for two reasons:
1) Model swapping is against the terms of use, is not the same thing as a UI mod, and can be used to do some very exploitative things.
2) Speech2.mpq is involved in the GM Island hack that's been making the rounds recently. (Yes, Batta, feel free to delete that. :p )
Some clarification in a different color would be nice here, though. :)

Game Master Zollrendir is mistaken. It is indeed against the Terms of Service and/or the EULA.

EDIT: Faizaniel, you might have some issues regarding contradicting GMs, however, I've been doing it since before I got MVP and I'll be damned if the green text makes me stop. :-D

Changing the in-game models/art or changing the sound files is indeed against the Terms of Use. This can be found at the following location:

2. Limitations on Your Use of World of Warcraft.

Your license to use World of Warcraft is limited by this Terms of Use and the World of Warcraft End User License Agreement which you were required to accept when you installed World of Warcraft. Limitations on your right to use World of Warcraft may include, but not necessarily be limited to, the following:

    B. Only Blizzard Entertainment or its licensees have the right to host World of Warcraft! Accordingly, you may not host, provide matchmaking services for, or intercept, emulate or redirect the communication protocols used by Blizzard Entertainment as part of World of Warcraft, regardless of the method used to do so. I am sorry that the answer you received was inadequate with this matter. The Game Master appears to believe you were referring to Interface modifications rather than to the client itself. Changing or editing any of the World of Warcraft files themselves is not permitted.
