why am i downloading it right now? when i logged off to download some stuff i was wondering why i was going so slow, then i see the blizzard icon on my mini tool and says im 28% complete downloading... and still going

So Wrong.
Pre-BC patch took how long? Major Content Patches (like this one) usually will Background download for weeks before a final installment is released (patch day).

We have had a number of patches begin downloading the content before they are released, especially when they have a lot of new content like in this case the new dungeon Zul'Aman. This download doesn't guarantee any specific release dates, just that it will be soon.

While Blizzard doesn't give release dates otther than "soon", they did used to to say on Mondays whether or not the patch will go live the next day.
So which is it Blue?

You downloaded a small chunk ... probably the ZA lay out, The Rokk and his quests, fishing nodes around Kara and ZA, stuff that does not need extensive testing.
Something broken can be fixed instead of thrown out.
Should the aproach to a fix resemble a sincX fuction or a e^(-x) ... where y=zero is the most desireable.

Blizzard distributes their patches via Bittorrent. This way, they don't' have to flip the bill for all the bandwidth. The early "downloaders" are just so that they have more seeders/leechers once "soon" comes around.

The performance hit you feel is them leeching your upload bandwidth and cpu cycles. Do yourself a favor and just turn it off. You can download the patch from "reputable" sites minutes after Blizzard announces it. I mean, sharing is caring, but come on... at least give us an option to throttle the upload or something, geebus!
